Terms of Service

§ 1 Scope and contracting party

(1) Diese Nutzungsbedingungen regeln das Rechtsverhältnis zwischen Tim Vida, In den Zeuläckern 20, 60389 Frankfurt am Main (nachfolgend „Anbieter") und den Nutzerinnen und Nutzern (nachfolgend „Nutzer") der unter tera-one.de und dashboard.tera-one.de erreichbaren Dienste sowie des unter dem Namen „TeraOne" auf der Plattform Discord betriebenen Bots (nachfolgend gemeinsam „Dienst").

(2) Deviating, conflicting, or supplementary general terms and conditions of the User shall only become part of the contract if and to the extent that the Provider has expressly agreed to their application in writing.

(3) By first using the Service — in particular by inviting the bot to a Discord server or logging in to the dashboard — the User accepts these Terms of Service.

§ 2 Description of services

(1) The Provider makes available a Discord bot including a web-based dashboard for configuration. The features include — depending on the activated module — in particular moderation tools, welcome messages, auto-roles, reaction roles, audit log, YouTube notifications, leveling system, anti-alt detection, and the provision of a custom bot per Discord server.

(2) The scope of features may be extended, modified, or reduced over time. There is no entitlement to the continued existence of individual features.

(3) The Service requires a user account with Discord Netherlands B.V. ("Discord"). The current terms of service and policies of Discord Netherlands B.V. apply exclusively to the use of Discord.

§ 3 Fees

(1) Use of the Service is currently free of charge. The Provider reserves the right to make individual features or the entire offering subject to a fee in the future. Features already unlocked will remain available to existing Users at no charge within the scope provided prior to the change, insofar as the Provider publicly commits to this at the time of the change.

(2) The Provider will give reasonable advance notice of the introduction of paid features.

§ 4 Registration and access

(1) Zur Nutzung des Dashboards meldet sich der Nutzer über den OAuth2-Login von Discord an. Der Anbieter erhält dabei ausschließlich die über den OAuth2-Scope freigegebenen Informationen, insbesondere Discord-Benutzer-ID, Benutzername und Avatar sowie die Liste der Server, auf denen der Nutzer administrative Berechtigungen besitzt. Einzelheiten zur Datenverarbeitung regelt die Datenschutzerklärung.

(2) The User is obligated to keep their Discord access credentials confidential and not to make them accessible to third parties.

(3) Inviting the bot to a Discord server requires the inviting User to have the necessary permissions on the respective server. The Provider does not itself verify permission-related requirements and accepts no liability for invitations made in violation of internal server rules or Discord's own policies.

§ 5 User obligations

(1) Der Nutzer verpflichtet sich, den Dienst nur im Rahmen der geltenden Gesetze und unter Beachtung der Nutzungsbedingungen sowie der Community-Richtlinien von Discord (https://discord.com/terms, https://discord.com/guidelines) zu nutzen.

(3) The User ensures that all persons whose data is processed through the use of the Service are informed of the data processing where required, and that the use of the Service is in compliance with the applicable data protection law, in particular the General Data Protection Regulation (GDPR).

(4) If the User uses the "Custom Bot" feature and stores their own bot tokens, they alone are responsible for ensuring that the use of these bot tokens complies with Discord's terms. The Provider operates the custom bot technically in this case, but does not act as the operator within the meaning of Discord's policies.

§ 6 User content

(1) Content that the User creates or configures via the Service (e.g. welcome texts, rank card background images, reaction roles, automod rules) remains the property and under the copyright of the User.

(2) The User grants the Provider the non-exclusive, temporally and geographically unrestricted right to store, technically reproduce, distribute, and display such content to users of the respective Discord server for the purpose of operating the Service.

(3) The User warrants that they have the necessary rights to the content they upload and that no third-party rights (in particular copyright, trademark, or personal rights) are infringed. The User shall indemnify the Provider from claims by third parties in the event of culpable violations.

§ 7 Availability, maintenance, changes

(1) The Provider endeavors to operate the Service with high availability but does not guarantee any specific availability rate. Maintenance work, disruptions on the part of Discord, failures of third-party services, or force majeure may lead to temporary limitations.

(2) The Provider may further develop the Service at any time, adapt individual features, restructure, or discontinue them. Where essential features are permanently discontinued, the Provider will give reasonable advance notice to the extent technically and organizationally feasible.

§ 8 Suspension and removal

(1) The Provider reserves the right to exclude Users from the Service without notice and to remove the bot from individual Discord servers without prior notice if the User violates these Terms of Service, technical misuse is detected, or the User's behavior endangers the integrity or stable operation of the Service.

(2) In the event of a suspension, the User has no entitlement to the restoration of individual configurations or to the continuation of running modules.

§ 9 Liability

(1) The Provider is liable without limitation for intent and gross negligence, as well as in cases of injury to life, body, or health. In cases of simple negligence, the Provider is — except in cases of breach of material contractual obligations (so-called cardinal obligations) — not liable. Material contractual obligations are those obligations whose fulfillment makes the proper performance of the contract possible in the first place and on the observance of which the User may regularly rely. In the event of a breach of a cardinal obligation through simple negligence, liability is limited to the contractually typical, foreseeable damage.

(2) Liability under the Product Liability Act remains unaffected.

(3) Where the Service is provided free of charge, the Provider is liable — notwithstanding the provision in para. 1 — only for intent and gross negligence (§ 599 BGB by analogy).

(4) The Provider is not liable for content distributed by users or third parties via the Service, nor for disruptions caused by Discord Netherlands B.V., the User's internet service provider, or other third-party services.

§ 10 Data protection

§ 11 Term and termination

(1) The user relationship commences upon first use of the Service and runs for an indefinite period.

(2) The User may terminate the user relationship at any time in the ordinary course by removing the bot from all Discord servers they manage and, if applicable, ceasing to use the dashboard account. No additional declaration to the Provider is required.

(3) The Provider may terminate the user relationship in the ordinary course with 14 days' notice to the end of the month. The right to extraordinary termination for good cause — in particular in the event of violations under § 5 and § 8 of these Terms — remains unaffected.

(4) After termination of the user relationship, server-specific data will be routinely deleted in accordance with the privacy policy, to the extent no statutory retention obligations apply.

§ 12 Amendments to these Terms of Service

(1) The Provider is entitled to amend these Terms of Service with effect for the future, to the extent this is necessary for a compelling reason (e.g. changes in the legal situation, higher court rulings, or material changes to the scope of features) and does not thereby create a not insignificant imbalance in the contractual rights and obligations to the detriment of the User.

(2) The Provider will inform the User of amendments by means of a notice in the dashboard or by email. If the User does not object to the amendments within six weeks of receipt of the notice, the amended terms shall be deemed approved. The User will be specifically informed of this legal consequence at the time of the amendment.

§ 13 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the User has their habitual residence remain unaffected.

(2) If the User is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship is the Provider's place of residence.

(3) Die Europäische Kommission stellt unter https://ec.europa.eu/consumers/odr eine Plattform zur Online-Streitbeilegung (OS-Plattform) bereit. Der Anbieter ist nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

(4) Should individual provisions of these Terms of Service be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by that valid and enforceable provision whose effect comes closest to the economic objective that the contracting parties pursued with the invalid or unenforceable provision. The same applies in the case of a gap in the provisions.
